Can I get a CDL with a felony or criminal record?

A felony is not an automatic federal ban on every CDL. If the offense involves listed vehicle conduct, check the federal disqualification tables first. If your record is unrelated to driving, that rule alone does not bar a CDL; ask the state about issuance and your driving privileges. Hazmat has a separate TSA assessment. School admission and carrier hiring are separate decisions, so request written answers before paying for training. This is not legal advice.

Which decision does your record affect?

A CDL, a school place, a hazmat endorsement and a driving job are separate decisions. Start with the actual offense, the vehicle involved, your current driving privileges and the intended work. This is general information, not legal advice. Ask the licensing agency or a qualified lawyer about your own record before paying nonrefundable charges.

Federal offenses involving a vehicle

49 CFR 383.51, checked November 2, 2026, ties disqualification to specified conduct. Using a vehicle to commit a felony is listed; using a vehicle for a controlled-substance manufacturing, distributing or dispensing felony has a separate lifetime provision. Using a CMV for severe human trafficking is also listed. Some major-offense rules apply to a CDL holder’s noncommercial driving, so “it was my car” does not settle the question. Use the disqualification tables for offense periods and reinstatement limits.

A criminal record unrelated to driving

Section 383.51 does not impose a blanket CDL ban for every felony or criminal record. If your offense is unrelated to the listed vehicle conduct, that section alone does not establish a bar. It also does not guarantee issuance. States issue CDLs under federal minimum standards (checked November 2, 2026). Ask your state to check its additional rules, license status and any restoration conditions. Start with your state licensing steps and agency sources.

If a record was sealed, expunged or otherwise changed, do not assume every application treats it the same way. Ask a qualified adviser what the actual question requires you to disclose. This guide does not interpret a court order or tell you how to answer a background questionnaire.

Hazmat has a separate TSA security threat assessment

A CDL without H and permission to transport placarded hazardous material are different decisions. 49 CFR 1572.5 requires security assessment standards, including criminal-history, immigration and other security checks. Section 1572.103 distinguishes permanent from interim disqualifying criminal offenses and pending charges or warrants. These rules can matter even when a record does not bar the basic CDL. Both checked November 2, 2026.

For a disputed assessment or possible relief, read TSA’s appeal process and waiver process, checked November 2, 2026. Eligibility for a waiver depends on the provision; an appeal or waiver is not automatic approval. The hazmat application guide covers the separate training, test and fee steps.

Ask about school admission and hiring in writing

School admission and carrier hiring policies vary. Ask each organization about the exact record and course or role through its verified process. A school’s acceptance cannot bind a future employer. A verbal indication is a poor basis for a nonrefundable deposit or travel expense.

  • Which convictions, dates, driving history and pending matters does your policy consider?
  • Can you assess my circumstances before I pay, and what documents do you need?
  • Is acceptance conditional on later screening? What happens to charges if that fails?
  • Does the planned work require hazmat or another endorsement with separate checks?
  • Can I keep the written decision and the policy version used?

Questions drivers ask

Does any felony automatically bar a CDL?

Section 383.51 does not impose a blanket ban for every criminal record. Check whether your conduct is listed and ask the state about your current license status and issuance rules. This is not legal advice.

Does a basic CDL establish hazmat eligibility?

No. A hazardous-materials endorsement has a separate TSA security threat assessment, including its own disqualifying-offense rules. Basic licensing and hazmat screening are different decisions.

Does school admission guarantee a driving job?

No. School admission and employer hiring policies vary and are separate from license issuance. Request current written decisions about your circumstances before paying nonrefundable charges.
